The US Securities and Exchange Commission will close public comment on its proposed crypto asset rules on Tuesday, ending a 60‑day window that began in August. The agency gathered roughly 140 submissions from industry groups, investors and other stakeholders on a safe‑harbor provision that would shield token issuers from being classified as investment contracts, as well as on disclosure exemptions for smaller offerings.
The Markets in Crypto Assets Alliance, a coalition focused on implementing the EU’s MiCA framework, endorsed the SEC’s disclosure‑focused amendments and suggested clearer definitions for crypto‑specific concepts and data structures. SkyBridge Capital founder Anthony Scaramucci also voiced support, saying the rules align with “organic adoption” and restore the Commission’s appropriate role, without referencing congressional inaction on the Digital Asset Market Clarity Act.
Six commenters chose to remain anonymous. While many submissions praised the SEC’s effort to create a regulatory structure, some legal analysts warned that agency rules may be more vulnerable to reversal than statutes passed by Congress. Both the SEC and the Commodity Futures Trading Commission continue to operate with interim leadership as staffing gaps persist.
