Six blockchain organizations, including Chainlink Labs and the Cardano Foundation, have asked the U.S. Securities and Exchange Commission to formally classify digital commodities as non-securities. In a letter dated Oct. 20, the groups — Chainlink Labs, the Cardano Foundation, Hedera, Aptos Labs, Ava Labs and the Stellar Development Foundation — said the SEC’s proposed crypto rules should embed its digital commodity classification directly into the draft Regulation Crypto Assets framework. They argued that relying only on interpretive guidance leaves market participants uncertain about which securities rules apply.
The letter also seeks clarification on how securities laws apply to secondary‑market trades of digital assets and on the treatment of staking and other activities tied to decentralized blockchain networks. The SEC’s proposed framework, released in August, attracted about 140 public comments over a 60‑day period, with industry participants and legal scholars offering differing views on exemptions for crypto offerings and a conditional safe harbor for certain tokens.
The groups contend that a clear, explicit classification would reduce legal ambiguity for developers and other stakeholders, while the SEC has not yet indicated how it will incorporate the feedback into the final rule.
